  2. Additional Terms and Conditions: the additional general terms and conditions applicable to the Workshops, Retreats and s organized by The Practice.
  3. Application form: The application form of The Practice that has to be filled out and signed by the aspiring participant prior to the Workshop, Retreat or (Pre) of The Practice.
  4. General Terms and Conditions: The general terms and conditions used by The Practice, which have been published at the The Practice website, thepractice.amsterdam. These General Terms and Conditions are also available for download at thepractice.amsterdam/legal/terms-of-use.
  5. The Practice: The Practice has its official seat at Orteliuskade 59-1, 1057AL Amsterdam and is listed in the Trade Register under number 69597685
  6. The Practice Card: a 10-class card or a 20-class card.
  7. Membership: the membership for attending yoga classes at The Practice, issued or to be issued by The Practice and paid or to be paid by the Student.
  8. Single Class: a single yoga class at The Practice to be attended and paid by the Student, other than on the basis of any Membership.
  9. Participant: the person who attends or wishes to attend a Retreat or Workshop.
  10. Price: the total price of a Workshop, (Pre-) or Retreat, including the Deposit/application fee.
  11. Private Class: a private yoga class at The Practice, for which the Student must make an appointment in advance.
  12. Private Card: a card for 5 or 10 private classes.
  13. Retreat: a yoga retreat organized by The Practice
  14. Student: a person who attends and/or wishes to attend private or group yoga classes, trainings, retreats or workshops at The Practice.
  15. Website: the website of The Practice: thepractice.amsterdam
  16. Workshop: A yoga- or yoga-related workshop given or to be given by The Practice.

 

Scope of Application

  1. The General Terms and Conditions apply to any membership and, where applicable, to all The Practice Cards, the Private Card and Single and Private Classes of and at The Practice as well as to all Retreats, Workshops.
  2. By participating in a Retreat, Workshop, (pre) or yoga class of The Practice, the Student agrees to the applicability of these General Terms and Conditions.
  3. The Practice may from time to time amend these General Terms and Conditions. The most recent version of the Terms and Conditions is always the version that is applicable and is always available at the Website. The Practice will announce any amendments to the General Terms and Conditions in advance by email.

  1. Monthly Membership, Yearly Membership, The Practice Cards, Private Card 60 and 90, Online Membership and Online Cards

The Practice offers the following possibilities of attending yoga classes at The Practice: 

  1. MONTHLY MEMBERSHIP AND YEARLY MEMBERSHIP
  2. The Monthly and Yearly Membership entitles the member to an unlimited number of yoga classes during the term of the Membership.
  3. The minimum Membership term for the Monthly Membership is one (1) month. After the first month, a Student’s Monthly Membership is tacitly converted into a continuing agreement for an indefinite period. The minimum Membership term for the Yearly Membership is twelve (12) consecutive calendar months. After the twelve months, a Student’s Membership will be tacitly converted into a Monthly Membership for an indefinite period.
  4. The Membership commences either on the agreed starting date or on the day the first payment is made by IDEAL, Paypal or Credit Card. The next monthly cycles will be paid by direct debit, until termination.
  5. After the minimum term of one (1) month, a Student’s Monthly Membership may be terminated every month. Membership must be cancelled prior to the individual renewal date in order to end membership charges. Cancellation of Monthly Membership must be processed by the Student through their My The Practice account. The Practice will not reimburse the Student for the remainder of any paid subscription period, nor will reimbursements be made for membership cancellations prior to any renewal date.
  6. A Student’s Monthly Membership may be put on hold for one (1), two (2) or three (3) months. This may be done by updating the membership settings in the Student’s My The Practice account up until 1 day prior to the start of the new month’s Membership. The Yearly Membership may also be put on hold for one (1), two (2) or three (3) months during the 12-month period. This month of suspension does not count for the 12-month period; if the membership is put on hold for one (1) month the end date of the contract will be extended with one (1) month.
  7. A Student may use any Membership only in the event of payment by direct debit (monthly Membership only).
  8. The Membership fee will be debited from the Student’s bank account around the starting day of the current Membership month. If this starts on the 1st of the Month (e.g. 1 March), the Membership Fee will be debited around the 1st of this month (e.g. around 1 March). If the membership starts on a different date of the Month (e.g. 17 March), the Membership fee will be debited around that same date (e.g. around 17 March). In case The Practice is unable to collect the Membership Fee on the first collection moment, The Practice will send the student a notification by email informing the student that the collection of the monthly membership payment has failed. There will be a second collection moment around the 10th or 25th day of the month (whichever is the closest date to receiving a notification). In case The Practice remains unable to collect the Membership fee with the second collection moment, an administration fee of €25 will be charged without prior notice. If the payment has not been made through no fault of the Student, no administration fee will be charged.
  9. All Dutch Bank accounts and bank accounts from European SEPA countries are supported for the direct debit payment (monthly Membership only).   10. A Student’s Membership commences when The Practice has received the membership fee from the Student.
  1. THE PRACTICE GUEST CLASS
  2. The The Practice Guest Class entitles the Student to one (1) yoga class.
  3. The The Practice Guest Class is valid for two (2) months from the date of purchase. The 1 class must therefore be attended within two (2) months of the date of purchase. After that period this right lapses.
  1. THE PRACTICE INTRODUCTION CARD
  2. The The Practice Introduction Card entitles the Student to five (5) yoga classes and can be purchased only once by new Students. A new Student may use the The Practice Introduction Card only if he or she has not attended more than one (1) yoga classes at The Practice.
  3. The The Practice Introduction Card is valid for one (1) month from the date of purchase. The 5 (five) classes must therefore be attended within one (1) month of the date of purchase. After that period, this right lapses.
  1. THE PRACTICE CARD 10-CLASSES / THE PRACTICE CARD 20-CLASSES
  2. The The Practice Card entitles the Student to ten (10) or twenty (20) yoga classes.
  3. The The Practice Card – 10 classes are valid for three (3) months after the date of purchase. The 10 classes must therefore be attended within three months of the date of purchase. After that period, this right lapses. The The Practice Card – 20 classes are valid for 6 months after the date of purchase. The 20 classes must therefore be attended within 6 months of the date of purchase. After that period, this right lapses.
  1. PRIVATE CARD 60 and 90
  2. The “Private Card 60” and the “Private Card 90” entitle the Student to five or ten private yoga classes of 60 and 90 minutes, respectively.
  3. The “Private Card 60” and the “Private Card 90” are valid for six months from the date of purchase. This means that the five or ten classes must be attended within six months of the date of purchase.
  1. INTRODUCTION TO YOGA PROGRAM
  2. The “Introduction to Yoga Program” entitles the Student to one 2-hour introduction Workshop and three yoga classes.
  3. The “Introduction to Yoga Program Workshop” is valid for six months from the date of purchase. The introduction workshop must therefore be attended within six months of the date of purchase. After that period, this right lapses. The “Introduction to Yoga Program three yoga classes” are valid for one month after the date of the attended “Introduction to Yoga Program Workshop”. After that period, this right lapses.
  1. ONLINE MEMBERSHIP WEEKLY / ONLINE MEMBERSHIP MONTHLY
  2. The “Online Membership” entitles the Student to an unlimited number of online yoga classes during the term of the Membership.
  3. Online Classes can be viewed up to a minimum of one month prior to when they have been broadcasted. Except for Zoom Classes, Zoom classes will not be recorded because of privacy reasons.
  4. The minimum Membership term for the Monthly Online Membership is one (1) month. After the first week, a Student’s Online Membership is tacitly converted into a continuing agreement for an indefinite period.
  5. After the minimum term of one (1) month, a Student’s Monthly Online Membership may be terminated every month. A Membership must be cancelled prior to the renewal date in order to end membership charges. Cancellation of Online Membership must be processed by the Student through their My The Practice account. The Practice will not reimburse the member for the remainder of any paid subscription period, nor will reimbursements be made for membership cancellations prior to any renewal date.
  6. The Online Membership commences on the day the first payment is made by IDEAL, Paypal or Credit Card. The next weekly cycles will be paid by direct debit, until termination.
  7. The Student can not freeze the The Practice Online membership unless The Practice is not able to deliver the online service to support it.
  8. All Dutch Bank accounts and bank accounts from European SEPA countries are supported for the direct debit payment (monthly Membership only).   1. ONLINE CARD 1 CLASS / ONLINE CARD 5 CLASSES
  2. The The Practice Online Card entitles the Student to one (1) or five (5) online yoga classes.
  3. Online Classes can be viewed up to at least one month after they have been live-streamed. Except for Zoom Classes, Zoom classes will not be recorded because of privacy reasons.
  4. The The Practice Online Card 1 or the The Practice Online Card 5 classes is valid for one (1) month from the date of purchase. The 1 or 5 classes must therefore be attended within one (1) month of the date of purchase. After that period, this right lapses.
  5. Payment and Price Changes
  6. All yoga classes organized by The Practice must be paid for before they are held. The Practice does not accept cash payments. Payments can be made by direct debit (memberships only), PIN, Credit Card (Visa, Master Card), Ideal and PayPal.
  7. As a general rule, direct debits for memberships are made monthly around the 1st day of the membership. If the amount cannot be collected, a handling fee of €25 is charged. In the case of non-payment, The Practice reserves the right to suspend the account of the relevant Student after 1 month of overdue payment.
  8. The Practice reserves the right to change the pricing of all The Practice products. Any changes are announced in advance by putting up posters on the premises of The Practice, by placing statements on the Website, and/or by email. The currently applicable rates are always mentioned on the Website and are available for inspection at the reception desk of The Practice.
  9. On presentation of an official Student card, The Practice grants a 10% discount on all private and group yoga classes at The Practice, except for the Introduction Card and the Membership.
  10. Before joining a yoga class, workshop or training, the Student must check in at the reception desk of The Practice, or at the Teacher of an Outdoor class as the case may be. After the The Practice Employee or Teacher has verified the registration and payment for the relevant yoga class, the Student is allowed to enter the class, workshop or training.
  11. Reservations and cancellations for yoga classes
  12. All classes are available for online booking 7 days in advance.
  13. A Student can only book classes and smaller workshops online.
  14. A confirmed booking is valid until 5 minutes before the class starts. If the Student has not checked in by then, the booking expires and the reserved spot will become available to another Student.
  15. When a class is fully booked, the Student can sign up for the Waiting List. If a spot opens up, the first Student to book the class through the schedule will be notified by email.
  16. Students can cancel their booking until six (6) hours before the class starts. The Student can only cancel through the personal My The Practice Account, so not by phone or email.
  17. If the Student cancels within six hours before the beginning of the class, this will be noted as a “Late Cancel”. Up to three (3) Late Cancels are allowed. If the limit of three Late Cancels is exceeded, The Practice will reserve herself the right to suspend the possibility to book online for one month for this particular Student. In that case, the Student can still make use of one of the 3 walk-in spots in case they are available.
  18. If you have a (Introduction or The Practice) Card and you do not show up to this class or do not cancel it up until 6 hours in advance, this class will be charged from your card.
  19. Cancelling an appointment for a private class, massage or healing can be done without charge up to 24 hours before the start of the appointment. The Student will be charged in full if the private appointment is cancelled within 24 hours before the start of the appointment.
  20. Schedule
  21. The current schedule is mentioned on the Website. The Practice reserves the right to change the schedule at any time. If possible, any changes are announced in advance by putting up posters in the The Practice rooms, mentioning them on the Website or by email.
  22. The Practice reserves the right to cancel a yoga class that has been scheduled or to change the yoga teacher mentioned in the schedule in the event of force majeure, including illness of the teacher. In the case of replacement of a teacher, there will be no refund of any Membership fee.
  23. The Practice reserves the right to close its doors on public holidays or on other days, or when imposed by the government, in case of force majeure, national safety or a pandemic.
  24. Early Termination of Membership in case of illness
  25. In the event of prolonged illness or an injury, the Student may terminate the Membership early. A request for early termination must be submitted to The Practice in writing and The Practice reserves the right to evaluate and handle each case individually. This termination may be sent by email to info@thepractice.amsterdam.
  26. Liability
  27. Attending yoga classes, Workshops, Retreats and leaving belongings in the changing rooms are at the Student’s own risk. The Practice accepts no liability for loss or damage of personal belongings of a Student attending yoga classes, workshops, trainings or retreats and leaving belongings in the changing rooms at The Practice. If during a retreat or workshop the student causes loss or damage to the property of the venue where the student is staying, the student will be held liable. This loss or damage is in no way covered by The Practice. The student is considered to have the right insurance to cover this loss or damage.
  28. The Practice is not in any way liable for personal injuries sustained during yoga classes, workshops, trainings or retreats. Participating is always at the own risk of the Student.
  29. The Practice provides the following guidelines for reducing the risk of an injury:
    1. Always consult a doctor before starting yoga classes if you are not sure that you are completely healthy or if you are pregnant.
    2. If you have an injury or any other physical inconvenience, always inform your yoga teacher about this before starting the yoga class.
    3. Listen to and follow the instructions of the relevant yoga teacher.
    4. Perform the yoga exercises carefully and bear your physical limitations in mind.
    5. Do not perform any yoga exercises that are painful.
    6. Ask questions if you do not understand an exercise.
    7. Avoid inverted poses during menstruation.
  30. Although we strive to only provide correct information on our website, we are not liable for any inaccuracy and no rights can be derived therefrom.
  31. Personal Data
  32. The Practice collects personal data of the Students and Participants to update its membership records, to execute payment orders and for administration and information purposes. The Practice handles this collection of personal data with due care and complies with the provisions of the Dutch Data Protection Act.
  33. The Practice uses the personal data referred to in Clause 9.1 to inform the Students and Participants about activities of The Practice and any changes in the schedule, for example. If the Student or Participant does not want to receive communications from The Practice, he or she may unsubscribe from the mailing in the bottom of a received newsletter or communicate this to The Practice by sending an email to info@thepractice.amsterdam. The Student or Participant is aware (s)he cannot use all online services and products of The Practice in that case.
  34. The Practice never gives any personal data of the Students or Participants to third parties without their prior written consent.
  35. Governing Law and Dispute Settlement
  36. The General Terms and Conditions are exclusively governed by Dutch law.
  37. Any disputes relating to the General Terms and Conditions, any Membership, a The Practice Introduction Card, a The Practice Card, a Private Card or a Student’s attending group and private yoga classes, Workshops or Retreats organized by The Practice are settled exclusively by the competent court in Amsterdam or any higher court.
  38. Code of Conduct
  39. Students shall adhere to The Practice’s code of conduct at all times:
    1. Please make sure you are clean and fresh when you attend the yoga class. The use of unscented deodorant is highly appreciated. In view of potential allergies of other Students, everyone is asked not to wear any perfume, aromatherapy oils or other scented products, and not to use any spray deodorant in the changing rooms.
    2. Wear clean yoga clothes in yoga classes, in which you can move easily.
    3. The Practice advises not to eat later than two hours before the start of the yoga class and, in any case, not to do yoga on a full stomach.
    4. Please do not wear shoes in the yoga studios.
    5. Due to extra safety measures regarding the Covid-19 virus, we ask you to bring your own yoga mat and props when possible and to bring covers to cover our props during yoga classes, courses and workshops. Props may be used only when covered with a clean pillowcase, scarf or towel. The Practice makes yoga mats available for use during yoga classes and workshops only when the Student brought a yoga mat towel to cover the mat. After classes, a yoga mat must always be cleaned thoroughly and put back by the Student who has used it.
    6. To allow everybody to find perfect inner peace, Students are requested not to talk in the yoga studio before, during and after the yoga class and to talk quietly in the other rooms.
    7. The physical and mental integrity of Students must always be respected. Sexual behaviour or sexually suggestive behaviour is not tolerated by The Practice.
  40. The Practice reserves the right to deny Students who do not observe the house rules referred to in Clause 11.1, to deny access to the The Practice premises and to terminate the Membership of the relevant Student without a refund of any membership fee paid already.

ADDITIONAL GENERAL TERMS AND CONDITIONS FOR WORKSHOPS, (PRE-)S AND RETREATS OF THE PRACTICE

  1. Applicability of Additional Terms and Conditions and Definitions
  2. Retreats, s and Workshops are governed by these Additional Terms and Conditions in addition to the General Terms and Conditions. The General Terms and Conditions form an integral part of these Additional General Terms and Conditions. By participating in a Workshop, (Pre-) or Retreat, the relevant Participant accepts the applicability of the General Terms and Conditions and the Additional General Terms and Conditions.
  3. The Practice reserves the right to replace the teachers of Workshops, Retreats and Pre-s in case of illness or injury of the original teacher without further consequences. The Practice will guarantee that the replacement of a teacher will not affect the contents and quality of the training. Replacement of a teacher will therefore not be accepted as a valid reason for cancellation.
  4. Participation in Workshops and/or Retreats and Registration Fee
  5. A Participant may participate in a Workshop or Retreat after he or she has registered for it with The Practice in advance and paid the Price. Registration may be affected by signing up through the website or by sending an email to info@thepractice.amsterdam. A spot in the Workshop or Retreat is guaranteed after The Practice has received payment of the Price or the Deposit/application fee.
  6. For some Workshops and Retreats, an “Early Bird Rate” applies. This reduced rate applies until the date specified on the Website. After this date, the normal rate, which is also specified on the Website, applies without exception.
  7. All participants are responsible for having the correct insurance (travel and/or liability) needed to participate in the workshop or retreat.
  8. Payments and Prices
  9. The Price for a Workshop, Retreat or (Pre-) can be found on the The Practice website.
  10. Payments for a Workshop or Retreat must be made before the Workshop or Retreat is held. Payments can be made by direct debit, IDEAL, PayPal or Credit Card (Master or Visa Card) or with credit on your The Practice account as the case may be.
  11. In the event of participation in a Retreat, the Deposit/application fee must be paid 60 days before the scheduled Retreat at the latest. The balance must be paid 30 days before the Retreat scheduled at the latest.
  12. Deposits are non-refundable when:
    • The Student cancels on his/her own initiative for reasons other than named at 15.5.
    • The Student cancels due to postponement or changed start date/time of a Training, Workshop or Retreat by The Practice.
    • The Student decides to cancel because of changes in the Training, Workshop or Retreat due to force majeure.
    • The workshop is cancelled or postponed by The Practice for reasons due to force majeure. 
  13. Deposits will be converted into The Practice Credits if a Student cancels their participation in the Training, Workshop or Retreat due to personal force majeure like injury, physical illness, family emergencies, etc.
  14. If The Practice cancels a Training, Workshop or Retreat for reasons other than force majeure, the deposit and other payments will be refunded in full.
  15. The Price for a (Pre) and possible payment plans are mentioned on the Application Form under Financial Agreement.
  16. To complete the application for a (Pre) , a deposit/application fee payment must be made through the The Practice website via iDEAL, Credit Card or PayPal.
  17. The balance for the (Pre) needs to be paid no later than 4 weeks prior to the training start date. The Participant will receive an email from The Practice agreeing on the ways of paying the Price, including a possible payment plan.
  18. Cancellation of Workshop Registration
  19. Any participation in a scheduled Workshop may be cancelled only in writing. Cancellations can be done by sending an e-mail to: info@thepractice.amsterdam.
  20. In the cancellation policy, we make a distinction between small Workshops (€0 – €250) and large Workshops (€250 – €5000).
  21. Small Workshop registrations can be cancelled free of charge until one (1) month before the scheduled Workshop date.
  22. If the Participant cancels his or her registration for a small Workshop between one (1) month and two (2) weeks before the scheduled Workshop date, a handling fee of €25 will be charged.
  23. Large Workshop registrations can be cancelled free of charge until two (2) months before the scheduled Workshop date.
  24. If the Participant cancels his or her registration for a large Workshop between two (2) months and two (2) weeks before the scheduled Workshop date, the deposit will not be refunded. If there was no deposit paid for this particular workshop we will charge a handling fee of 50 euro.
  25. If the Participant cancels his or her registration for any workshop (large or small) later than two (2) weeks before the scheduled Workshop date, the registration fee is not refunded.
  26. In case of force majeure like a pandemic, natural disaster, terrorist attack, etc., The Practice withholds the right to postpone, to cancel or to make adjustments to Workshop without further liabilities.
  27. Cancellation of Participation in Retreat
  28. Any participation in a scheduled Retreat may be cancelled only in writing. This can be done by sending an email to academy@The Practiceyoga.nl.
  29. The Retreat Participant may cancel his or her registration free of charge until four (4) months before the scheduled Retreat.
  30. If the Participant cancels his or her Retreat between four (4) months and two (2) months before the scheduled Retreat, the deposit will not be refunded.
  31. In between two (2) months and one (1) month before the scheduled Retreat, the Retreat Participant may cancel his or her registration, in which case 50% of the Price is charged.
  32. If the Retreat Participant cancels his or her registration within one (1) month before the start of the Retreat, the Price will be charged to the participant as the case may be.
  33. If it turns out at the location of the Retreat that the Retreat Participant cannot participate in the Retreat for whatever reason, the Price already paid will not be refunded.
  34. The Practice reserves the right to cancel the Retreat if there are insufficient participants. In this case, the registration fee already paid by the Participants is refunded as soon as possible.
  35. In case of force majeure like a pandemic, natural disaster, terrorist attack,  etc., The Practice withholds the right to make adjustments to-, to postpone or to cancel the Retreat without further liabilities.
  36. Liability
  37. The Practice shall not be liable for any injury, loss or damages in connection with, or resulting from, participation in the Pre or the , as the case may be.
  38. The Participant will never engage The Practice, the Teachers, or any of the supporting staff, in legal proceedings relating to possible damages in whatever form, that may be the result of participation in the Pre or the , as the case may be.
  39. The Practice only works with qualified yoga teachers and will always offer yoga classes of the highest quality. Nonetheless, there is always a risk of injury involved when taking a yoga class. By participating in the Pre or the , as the case may be, the Participant accepts such risk of injury. The Practice offers the following guidelines to diminish the risk of injury:
  • Consult with a physician when you are not sure you are completely healthy, or if you are pregnant, before starting to take yoga classes.
  • If you have an injury, or other physical issues, inform the yoga teacher thereof before you start your yoga class.
  • Listen to and follow the instructions of the yoga teacher.
  • Be conservative when exercising yoga and listen to your physical limitations.
  • Do not do any exercises that are painful.
  • Ask questions when you do not understand an exercise.
